it was basically free traded it for 3 server hard drives that i did not pay anything for, so you tell me if it was free XD

I have had some problems with my ASUS 6870's. My problem wat the cooling didn't start soon enough. Had exact same problems like you describe.
Use the Radeon tools to set the fan speed higher (50% or so) and check your temperatures on a second display. I guess there is your problem.

The problem i had in detail:
The driver was set to a manual fan speed.
When i starten BF3 the fans tried to spin up but didnt (becouse they where set to manual).
I did a clean install of the drivers but still the same problem.
Then i found out about the fan settings. Now i set them to manual when i start playing a game.
Result, no more problems.

Highest temperatures i got with 1 of my cards was 103 degrees Celsius...... :S

Good luck and let me know what your card does with the manual fan speed settings and his temps.

By Radeon tools you mean "AMD VISION Engine Control Center"?
when i look at the fan settings it always says its on 10% and when i cranked it up sometimes it didn't do anything, i installed "MSI Afterburner" but later uninstalled it because i couldn't control the fans from "AMD ECC", and i have notice that the heat went up after i started the game, what it was doing before i removed it from my system was, when ever i started a game it kicked me out of the game and back to the desktop, so it wasnt showing me the striped screen..

Little update, The videocard is back from asus/alternate, just need to test it to see if everything is ok, pics will come later on..

they told me at alternate yesterday that is was difective so today it arrived so i was like wtf?, so i called told them tried it and it made sound from the fans so thats difective to me so i send it back :096:
